Terms & Conditions

1. As a precondition for the right to sponsorship, Sponsor must be a paid member in good standing. ISKCON Philadelphia reserves the right to (a) reject any Sponsorship and Layout Design for any reason at any time even though a reservation has been previously acknowledged (provided that, upon such cancellation, ISKCON Philadelphia shall return any payment received with respect to such rejected Sponsorship), and (b) refuse any application that does not completely conform to every detail, instruction, method and guideline determined by the ISKCON Philadelphia. (subject to change at any time by the ISKCON Philadelphia in its sole discretion).
2. Sponsor is solely responsible for any legal liability arising out of or relating to (A) the Layout contents, and/or (B) any material to which users can acquire through the sponsorship layout contents. Sponsor specifically represents and warrants that the Layout contents complies with ISKCON Philadelphia's layout standards, and that it holds all of the necessary rights to permit the use of the layout contents by ISKCON Philadelphia for the purpose of this Agreement; and that the use, reproduction, distribution, or transmission of the Layout contents will not violate any criminal laws or any rights of any third parties, including, but not limited to, such violations as infringement or misappropriation of any copyright, patent, competition, defamation, invasion of privacy or rights of celebrity, violation of any antidiscrimination law or regulation, or any other right of any person or entity. Sponsor agrees to indemnify ISKCON Philadelphia and to hold ISKCON Philadelphia harmless from any and all liability, loss, damages, claims, or causes of action, including reasonable legal fees and expenses that may be incurred by ISKCON Philadelphia, arising out of or related to Sponsor's breach of any of the foregoing representations and warranties.
3. In no event will ISKCON Philadelphia be liable to sponsor for any special, incidental or consequential damages, whether based on breach of contract, tort (including negligence), or otherwise, and whether or not ISKCON Philadelphia has been advised of the possibility of such damage.
4. ISKCON Philadelphia shall not be liable for errors in key numbers or for any delay or failure to print, publish, or circulate any part of any issue because of circumstances beyond its control. ISKCON Philadelphia can reject or cancel any sponsorship for any reason at any time.
5. All layout materials must be received by closing dates specified by the souvenir department. Neither sponsor nor its agency may cancel orders for publishing after closing date. Cancellations or changes must be in writing, and are not considered accepted until confirmed in writing by the ISKCON Philadelphia. Cover sponsorships are non-cancelable 60 days prior to closing date. Sponsors who cancel an insertion after the space reservation deadline will be charged 15% of the space rate as a cancellation fee.
6. Sponsor is liable for any production costs incurred in the preparation of layout.
7. All sponsorship reservations and materials must be received on or before the deadline. Late applications may be accepted at the discretion of ISKCON Philadelphia.
8. The sponsor is responsible for insuring that materials are submitted in acceptable formats. 9. ISKCON Philadelphia is not responsible for misspellings or other errors in layouts. Proofs are not provided.
10. ISKCON Philadelphia is not liable for delays in delivery and/or non-delivery in the event of an act of God, action by any governmental or quasi-governmental agency, fire, flood, insurrection, riot, explosion, embargo, legal or illegal strikes, labor or material shortage, transportation interruption of any kind, work slowdown, or any circumstances beyond the control of the ISKCON Philadelphia affecting production or delivery in any manner.
11. All points not covered here are subject to decisions by ISKCON Philadelphia.
